Terms and Conditions – TIDHEX

The Arabic text of these Terms is authoritative; this English translation is provided for convenience. In case of conflict, the Arabic text prevails.

1. Introduction and Acceptance

By using the TIDHEX platform or creating an account on it, you agree to these Terms and Conditions in full. If you do not agree with any part of them, please do not use the platform.

• These Terms form a binding agreement between you and TIDHEX, based in Mezzeh, Damascus, Syria.
• These Terms apply to the website, the user dashboard, the tools for analysing and modifying control-unit files, and all related services.
• Users must be at least 18 years old, have the legal capacity to enter into a contract, and be a qualified technician or work under the supervision of one.
• The service is intended for businesses only (technicians, workshops and specialised companies) and not for individual consumers. You confirm that you are contracting for a professional or commercial purpose, not a personal or consumer one.

2. Description of the Service

TIDHEX is a specialised technical platform for Volvo, Renault and UD trucks, intended only for qualified technicians and workshops.

• The services include analysing and processing control-unit files, managing diagnostic trouble codes (DTC), and any other technical tools the platform adds from time to time.
• The service is provided "as is" and "as available". We aim for continuous operation but do not guarantee that the service will be free of interruptions or errors.
• TIDHEX may add, change or discontinue any feature, or change the supported units, without prior notice.
• The service may be temporarily unavailable for maintenance or updates; we try to announce this in advance where possible.
• TIDHEX is independent and is not affiliated with, or a representative of, Volvo, Renault Trucks, UD Trucks or Bosch. All trademarks belong to their respective owners and are mentioned for identification only.

Purpose of the Platform

The purpose of the TIDHEX platform is educational, research and informational: understanding, analysing, studying and training on the structure of control-unit files.

• All tools, outputs and resulting files are provided for this purpose only and are not a recommendation or invitation to install them on any vehicle.
• TIDHEX gives no advice or guidance on writing files to control units or on operating vehicles with them on public roads.
• Anyone who uses the platform or its outputs for any other purpose, including installing files on actual vehicles, does so on their own decision and bears sole and full responsibility — technical, legal and financial — towards the vehicle owner, the authorities and any other party.
• The availability of a feature on the platform is not an acknowledgement by TIDHEX that its use is lawful in the user's country.

3. Account and Licence

Each account (licence) is licensed to a single customer only. Using the same licence for more than one customer will result in the account being banned.

• The licence is personal, non-exclusive, and may not be transferred, assigned, rented or resold.
• You may not share your login details with anyone else, or operate the same account to serve more than one customer, workshop or company.
• TIDHEX may monitor usage indicators (devices, locations, concurrent sessions) to detect sharing.
• Where sharing is established, or there are reasonable indications of it, TIDHEX may ban the account immediately and without prior notice, with no refund of any amounts paid.
• You are responsible for keeping your login details confidential and for all activity carried out through your account, and you must notify us immediately if you suspect any unauthorised use.
• Registration details must be accurate and kept up to date. Misleading details are sufficient grounds to suspend the account.
• Workshops that need more than one user or branch should contact us for additional licences.

Linking the Account to Devices

TIDHEX may link each account to a set number of registered devices, up to a maximum of two (2) unless the plan states otherwise.

• The platform may register a device when it is used to sign in, and keep the device fingerprint, the session history and connection addresses.
• TIDHEX may limit an account to one active session at a time, and end the previous session when a new device signs in.
• A registered device is replaced on request through support, and TIDHEX may limit this to once every 30 days.
• The account may not be operated through remote-control software, virtual machines, or any other means that lets another party use it.
• Platform records (devices, sessions, locations, file-upload patterns) are accepted as evidence of sharing, and TIDHEX may rely on them in its decisions.

4. Fair Use Policy

Each account is subject to a fair-use limit of 100 actual files per month. When the limit is exceeded, TIDHEX contacts the customer before taking any action.

• The limit is counted on unique actual files. Reprocessing the same file for the same vehicle does not count as a new file.
• The counter resets at the start of each monthly subscription cycle; unused allowance does not carry over to the next month.
• The platform may notify the user as they approach the limit, and the account is not suspended automatically when the limit is exceeded.
• When the limit is exceeded, the TIDHEX team contacts the customer to ask about the nature of the usage. Exceeding the limit is not in itself a breach.
• Exceeding the limit is accepted if the customer justifies it with genuine workload, such as a high-volume workshop, a vehicle fleet or a busy season. TIDHEX may reasonably ask for supporting evidence, such as vehicle chassis numbers or work orders.
• If the justification is accepted, the account continues without restriction, and TIDHEX may raise the limit for that customer or suggest a plan that suits their volume.
• If the customer does not respond within 7 days, or does not give an acceptable justification, TIDHEX may temporarily restrict processing until the start of the next cycle.
• If the indicators point to account sharing or resale of the service, Section 3 applies.
• Automated or scripted uploads (bots / scripts), and any use that overloads the servers or affects other users, are prohibited.

5. Technical Support and Response Times

We aim to reply to support requests within minutes, and processing may take up to 72 hours, counted within actual working hours. These times are an internal standard we work to and not a contractual commitment.

• We do our best to reply within minutes even on holidays and outside working hours, without this being an obligation on TIDHEX.
• The 72-hour period is an internal operational target and does not include weekends or public holidays.
• Failure to respond or process within these times is not a breach of these Terms and gives no right to compensation, a refund or an extension of the subscription.
• Support is provided only through official TIDHEX channels (the ticket system inside the platform or the contact methods published on the website), or through the authorised distributor in your region.
• Support is limited to original, unmodified files read directly from the control unit. Files previously modified with other tools or by other parties may be refused or processed without any guarantee.
• The user must provide complete and accurate information about the vehicle, the unit and the read/write tool. Delays in providing it delay processing.
• Support does not cover teaching the basics of the trade, faults in third-party read/write tools, or mechanical or electrical faults in the vehicle.
• A reply does not guarantee that the problem will be solved; some cases need more time to analyse or may have no solution.

6. Disclaimer and Limitation of Liability

You use the platform and its outputs entirely at your own risk, and TIDHEX disclaims all liability for any malfunction in control units or failure of hardware components.

• This includes, without limitation: damage to the control unit or it ceasing to work (bricking), read or write failures, data loss, faults in the engine, transmission or after-treatment system, and any damage to wiring, sensors or programming tools.
• The user alone is responsible for taking a full backup of the original file before any write, and for checking that the file matches the vehicle and the unit (HW/SW numbers) before proceeding.
• The user alone is responsible for a safe working environment: stable battery voltage, sound connections, and a working read/write tool.
• TIDHEX does not guarantee that any file will achieve a particular result, be fit for a particular purpose, or be free of errors.
• TIDHEX is not liable for any direct, indirect or consequential damage, including vehicle downtime, loss of profit, claims by the user's customers, and loss of the manufacturer's warranty.
• In all cases, and to the fullest extent permitted by law, TIDHEX's total liability shall not exceed the amount the user actually paid for the most recent month of subscription.

Legal Compliance

• Some modifications, particularly those relating to emissions systems or immobiliser (IMMO) protection, may be unlawful in some countries or restricted to off-road use.
• The user alone is responsible for making sure that what they carry out is lawful in their country and that they act with the vehicle owner's authorisation, and bears any violations or fines that result.

Indemnity

The user shall indemnify TIDHEX and its distributors against any claim or loss arising from their use of the platform, their breach of these Terms, or their installation of any file on any vehicle.

7. User Obligations and Prohibited Uses

The user shall use the platform for lawful professional purposes only, and is prohibited from:

• Reselling, distributing or publishing output files, or building a file database from them, without written permission from TIDHEX.
• Reverse-engineering the platform or its algorithms, or comparing files in order to extract and copy the solutions.
• Attempting to breach the platform, bypass its protection and licensing systems, or probe it for vulnerabilities without permission. TIDHEX reserves the right to take legal action.
• Using the platform on stolen vehicles or vehicles of unknown origin, or for any fraudulent purpose, such as tampering with the odometer or identity data in order to mislead.
• Uploading malicious files, or files the user has no right to handle.
• Impersonating an authorised distributor, or using the TIDHEX name and logo without written permission.
• Abusing the support team, or defaming the platform with false information.

Protection of Algorithms and Solutions

TIDHEX's solutions and algorithms are the core of the platform, and any activity aimed at extracting or copying them is prohibited:

• Comparing the original file with the output file, manually or with comparison software or competing modification tools, in order to extract the changes, maps or addresses.
• Uploading files systematically or in sequence in order to map what the platform changes, or uploading previously modified files to test how the algorithms behave.
• Using platform outputs to build, train or improve a competing tool, solution database or service, or passing them to anyone who does so.
• Automatically scraping platform data, intercepting its communications, or analysing its programming interfaces.

This prohibition does not cover the use of the comparison and analysis tools available inside the platform itself, within what they are designed for.

Where any of the above is established, TIDHEX may, in addition to banning the account, claim compensation and seek urgent court orders to stop the infringement.

Breach of any of these provisions entitles TIDHEX to suspend the account under Section 10.

8. Fees, Subscriptions and Refunds

Subscriptions are paid in advance, and amounts paid are non-refundable once the account has been activated or the service used.

• Prices and plans are those published on the website or by the authorised distributor at the time of purchase, and TIDHEX may change them for future cycles.
• The subscription renews according to the chosen plan. Failure to pay on time suspends the account until renewal.
• No amount is refunded because of non-use, lack of support for a particular unit, or an account ban resulting from a breach of these Terms.
• Exception: if TIDHEX is unable to activate the service at all for a reason on its side, the amount is refunded in full.
• Opening a payment dispute (chargeback) without contacting us first results in the account being suspended immediately.
• Purchases through authorised distributors are subject to the distributor's terms for invoicing and payment, and these Terms continue to apply to the use of the platform.
• Prices do not include taxes or transfer fees unless stated otherwise.

9. Intellectual Property and Privacy

All rights in the platform, its algorithms, solutions, databases, designs and trademark belong exclusively to TIDHEX.

• These Terms give the user no ownership rights, only a limited licence of use under Section 3.
• The user remains responsible for the files they upload, and grants TIDHEX the right to store, process and analyse them to provide and develop the service and improve the solutions.
• TIDHEX may use any feedback or suggestions the user provides without compensation.

Privacy and Data

• We collect registration and contact details, usage and device records, and uploaded files together with the technical data they contain, such as the vehicle identification number (VIN).
• This data is used to operate the service, provide support and billing, prevent abuse, and apply the licensing and fair-use policies.
• We do not sell user data. We may share the minimum necessary with hosting and payment providers and the relevant authorised distributor, or when required by a binding legal request.
• Data is processed in accordance with the laws in force in the Syrian Arab Republic. The user may ask, through the support channels, to access, correct or delete their data.
• Further details are published in the Privacy Policy on the website, which forms part of these Terms.

10. Suspension, Termination and Changes to the Terms

TIDHEX may suspend or terminate any account immediately for breach of these Terms, without refunding amounts paid.

• Grounds for suspension include: account sharing, resale of the service, reverse engineering, exceeding fair use without an acceptable justification, payment disputes, and unlawful use.
• The user may stop their subscription at any time, and the account remains active until the end of the paid period.
• The user may appeal a ban decision through the support channels within 14 days; the final decision rests with TIDHEX.
• After termination, the provisions on disclaimer, indemnity, intellectual property and governing law remain in force.

Changes to the Terms

• TIDHEX may change these Terms at any time, and the change is published on the website with the date of the latest update.
• Users are notified of material changes through the platform or by email.
• Continued use of the platform after a change is published constitutes acceptance of it.

11. Governing Law and General Provisions

These Terms are governed by the laws of the Syrian Arab Republic, and the courts of Damascus have jurisdiction over any dispute arising from them.

• The parties shall first try to settle any dispute amicably within 30 days of written notice of it, before going to court.
• Force majeure: TIDHEX is not responsible for any delay or interruption caused by events beyond its control, such as internet and hosting failures, cyber-attacks, disasters and government decisions. TIDHEX's obligations are suspended for the duration of the event and its effects.
• Severability: if any provision of these Terms is invalid or unenforceable, the remaining provisions remain in force.
• No waiver: TIDHEX's failure to exercise any right is not a waiver of it.
• Entire agreement: these Terms, together with the Privacy Policy, form the entire agreement between the user and TIDHEX.
• Language: these Terms are published in Arabic and English; in case of conflict, the Arabic text prevails.

Security of Systems

Any attack on TIDHEX's systems, or interference with their operation, exposes the person responsible to civil and criminal proceedings.

• This includes intrusion attempts, denial-of-service attacks, bypassing licensing or usage limits, planting malicious software, and accessing other people's accounts or data.
• TIDHEX may investigate any suspicious activity, keep the related records, and suspend the account as a precaution during the investigation.
• TIDHEX may report to, and cooperate with, the competent security and judicial authorities, and claim the full damages and costs from the person responsible.
